Mortgage Broker Fee Agreement for Financial Services

Notice to Prospective Borrower(s): Read this contract carefully so that you can make an informed choice. You are entitled to a copy of this contract. Accepting the terms of this contract does not obligate you to obtain a mortgage loan through this mortgage broker, nor does it constitute mortgage loan approval.

Who do I Represent?

Broker Match, Inc., as your mortgage broker, is acting as your agent in providing mortgage brokerage services. As your agent, Broker Match, Inc. owes you a duty of the utmost care, honesty and loyalty, including full disclosure of all material facts. Broker Match, Inc. does not have an agency relationship with any other person.

Broker Match, Inc. will provide you with multiple conditional loan offers through its network of U.S. based Banks, thrifts, mortgage bankers and finance companies (“Lenders”). Broker Match, Inc. is a computerized loan originator. Broker Match, Inc. does not take applications, make loans or credit decisions in connection with loans nor does Broker Match, Inc. issue commitments or lock-in agreements. Broker Match, Inc services are only administrative. Any loan request you submit is NOT an application for credit. Rather, it is a request to be matched with Lenders to receive conditional loan offers from these Lenders. You may have to complete an application with a Lender before they will extend an unconditional loan offer. A Lender you select may require you to pay an application fee or other fee to cover the costs of an appraisal, credit report or other items. The Lender will determine the amount of any such fee and should provide information to you regarding the refund of any such fee.

Services to be Provided by Mortgage Brokerage Business

Broker Match, Inc. will perform the following services for you: (1) make loan request forms available to you; (2) transmit your completed loan request to Lenders; (3) offer you access to general educational information concerning home financing including glossaries, articles and calculators; and (4) provide you with the initial loan offers from Lenders responding to your loan request. Note: initial loan offers are provided only when you complete a traditional (full-form) Broker Match, Inc. loan request. If you submit a complete loan application with any of the Lenders, these Lenders will provide you with a good faith estimate of the settlement costs in connection with your loan in accordance with applicable law.

Lender Payments to Broker Disclosure

I understand that, as compensation for its services, Broker Match, Inc. will be paid as follows:
Broker Match, Inc does not charge you a fee to use its service.

Co-Brokering

Broker Match, Inc. does not co-broker loans in South Carolina.

Borrower Payments to Broker Disclosure

By submitting your loan request form, you acknowledge receipt of and that you have read and understood this Mortgage Broker Fee Agreement for Financial Services.

Attention Borrowers: Know Your Rights!

This may be the largest and most important loan you get during your lifetime. You should be aware of certain rights before you enter into any loan agreement.

  1. You have the RIGHT to shop for the best loan for you and compare the charges of different mortgage brokers and lenders.
  2. You have the RIGHT to be informed about the total cost of your loan including the interest rate, points and other fees.
  3. You have the RIGHT to ask for a Good Faith Estimate of all loan and settlement charges before you agree to the loan and pay any fees.
  4. You have the RIGHT to know what fees are not refundable if you decide to cancel the loan agreement.
  5. You have the RIGHT to ask your mortgage broker to explain exactly what the mortgage broker will do for you.
  6. You have the RIGHT to know how much the mortgage broker is getting paid by you and the lender for your loan.
  7. You have the RIGHT to ask questions about charges and loan terms that you do not understand.
  8. You have the RIGHT to a credit decision that is not based on your race, color, religion, national origin, sex, marital status, age, or whether any income is from public assistance.
  9. You have the RIGHT to know the reason if your loan was turned down.
  10. You have the RIGHT to ask for the HUD settlement costs booklet “Buying Your Home”.
  11. You have the RIGHT to request a copy of your settlement statement (Form HUD-1 or 1-A) one day prior to your loan closing.
